mystrategyTM Licence and Warranties
The mystrategy® software is
the property of Global Strategy Dynamics, HVR Consulting Services, Warren
Strategy Development and the Centre for Strategy Dynamics (the Consortium), and
is protected by copyright law. Global Strategy Dynamics acts on behalf of the
Consortium and is the trademark owner.
The Consortium grants you a licence to use the software under the following
terms.
You may:
(i) use only one copy of the Software on a single computer;
(ii) make one copy of the Software and documentation for archival purposes;
(iii) after written notice to Global Strategy Dynamics, transfer the Software
on a permanent basis to another person or entity, provided that you retain no
copies of the Software and the transferee agrees to the terms of this
agreement; and
(iv) if a single person uses the computer on which the Software is installed at
least 80% of the time, then after registering the product, that person may also
use the Software on a single home computer or laptop, a second registration
being available through the same system as the first.
You may not:
(i) copy the documentation which accompanies the Software;
(ii) sublicense, rent or lease any portion of the Software;
(iii) reverse engineer, decompile, disassemble, modify, translate, make any
attempt to discover the source code of the Software, or create derivative works
from the Software except for models created with it.
Limited Warranty:
Global Strategy Dynamics does not warrant that the Software will meet your
requirements or that operation of the Software will be uninterrupted or that
the Software will be error-free. The Consortium will provide technical support
and will, where considered appropriate, make available software updates to all
registered users of MyStrategy.
Disclaimer of Damages:
IN NO EVENT WILL GLOBAL STRATEGY DYNAMICS OR THE CONSORTIUM BE LIABLE TO YOU
FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST
PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE
EVEN IF GLOBAL STRATEGY DYNAMICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES. IN NO CASE SHALL GLOBAL STRATEGY DYNAMICS'S LIABILITY EXCEED THE
PURCHASE PRICE FOR THE SOFTWARE.
General:
This Agreement will be governed by the laws of England.
